These Terms and Conditions ("Legal Terms") constitute a legally binding agreement between you and East Texas Carports LLC regarding your access to and use of our website, custom builder tool, and steel building services.

Quick Summary

These terms govern your use of our website and steel carport/building services. Final orders must be placed by phone — our online tool provides estimates only. We serve Texas, Arkansas, Oklahoma, Louisiana, Kansas, and Mississippi (see our specific coverage per state below and on each state's service page). You must be 18+ to use our services or enter into contracts.

1. Legal Agreement & Company Information

East Texas Carports LLC is a registered company in Texas, United States, located at 1001½ W. Cotton St., Longview, TX 75604. Business registration is verifiable through the Texas Secretary of State's business registry.

These Terms and Conditions ("Legal Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) and East Texas Carports LLC ("Company," "we," "us," "our") regarding your access to and use of our services. The terms apply to the website at easttexascarports.com, the custom builder tool, all steel carport and metal building services, and related products, services, or communications.

We never share your personal information with competitors. We only share data with trusted service providers assisting with delivery and installation.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree with all terms, you are prohibited from using our services and must discontinue use immediately.

Our services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for our services or enter into contracts for steel building construction.

Geographic Coverage by State

Coverage varies by state — some states have specific regional limitations. See each state's dedicated service page for the full, current picture; the summary below reflects our actual coverage, not a blanket statewide claim.

  • Texas: Longview, Marshall, Tyler, Dallas, Houston, Austin, San Antonio, and most of the state — excluding areas more than 30 minutes south of San Antonio, the Rio Grande Valley, and Far West Texas (including El Paso, McAllen, Laredo, and Brownsville).
  • Arkansas: Little Rock, Fort Smith, Fayetteville, and all 75 counties statewide.
  • Oklahoma: Oklahoma City, Tulsa, Norman, and all 77 counties statewide.
  • Louisiana: Shreveport, Monroe, Alexandria, Lafayette, and Lake Charles — North, Central, and Southwest Louisiana. We do not currently serve the Greater New Orleans metro area or southeastern Louisiana.
  • Kansas: Wichita, the Kansas City metro, Topeka, and 51 counties across south-central and eastern Kansas. We do not currently serve western Kansas.
  • Mississippi: Jackson, Tupelo, Hattiesburg, and 76 of Mississippi's 82 counties. We do not currently serve the Gulf Coast counties (Hancock, Harrison, Jackson County, Pearl River, Stone, and George), including Gulfport and Biloxi.

Our services are not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA. If your project requires compliance with such regulations, please discuss specific requirements during consultation. The information provided through our services is intended for distribution and use within our designated service area; users accessing our services from other locations do so at their own initiative and are responsible for compliance with local laws and regulations.

3. Intellectual Property Rights

East Texas Carports owns or licenses all intellectual property rights in our website content, software (including our custom builder tool and databases), trademarks, custom building design plans and structural specifications, and photography.

Your Licensed Use

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal or business purposes, use our custom builder tool for preliminary design and pricing, download or print content for your personal project planning, and share our content for legitimate business purposes with attribution.

Restrictions

You may not copy, reproduce, or redistribute our content for commercial purposes; modify, adapt, or create derivative works from our materials; use our trademarks or logos without written permission; reverse engineer our software or custom builder tool; or remove copyright or proprietary notices from any content.

Your Submissions to Us

When you submit information to us (questions, project details, feedback), you grant us the right to use your submissions to provide quotes and services, retain project information for warranty and service purposes, use anonymous project data for business improvement, and feature completed projects in marketing materials with your permission.

4. User Responsibilities & Representations

By using East Texas Carports services, you represent and warrant that:

Legal Capacity & Age

  • You have the legal capacity to enter into these terms
  • You are at least 18 years old and not a minor in your jurisdiction
  • You have authority to act on behalf of any entity you represent

Compliance Commitments

  • You will comply with all terms outlined here
  • You will not access our services through bots or scripts
  • Your use will not violate any applicable laws

Information Accuracy

  • All information you provide will be true and current
  • You will update information promptly when it changes
  • Contact information will be valid and monitored

Project-Specific Responsibilities

  • You will provide accurate site measurements and conditions
  • You will obtain necessary permits and approvals
  • You will comply with local building codes and restrictions

If you provide false, inaccurate, or misleading information, we reserve the right to suspend or terminate your access to our services and refuse current or future service requests.

5. Prohibited Activities

East Texas Carports services may only be used for legitimate business and personal purposes. Prohibited activities include, without limitation:

  • Systematically retrieving data to create databases or directories, or copying/distributing our content without permission
  • Attempting to circumvent security features, uploading viruses or malware, or using bots/scripts to access our services
  • Providing false information to obtain quotes or services, impersonating another person, or submitting fraudulent payment or credit information
  • Using our services for any illegal purpose, or harassing, threatening, or defaming our staff or the company
  • Reselling or redistributing our services without authorization, or using our custom builder tool for competitor analysis
Violation of these prohibited activities may result in immediate termination of services, legal action, and cooperation with law enforcement authorities as appropriate.

6. User-Generated Content

While our website does not currently allow public content posting, you may submit information through contact forms, email, phone consultations, and photo submissions of project sites or completed work.

Any content you submit must be accurate, legal, respectful, and relevant to steel building services. You may not submit content that is false or misleading, harassing or abusive, obscene or inappropriate, infringing on third-party rights, or promoting illegal activity.

When you submit content, you grant us the right to use it to provide quotes and services, retain records for warranty and business purposes, and reference general project details for business development. We will always request specific permission before using any customer project photos in marketing materials — you retain ownership of all photos you submit to us.

7. Third-Party Websites & Content

Our website may contain links to third-party sites (building code resources, weather services, partner and supplier sites, industry associations). We are not responsible for the accuracy, content, or practices of third-party websites, their privacy policies or data handling, or any products or services offered through third-party links.

We may work with third-party service providers for delivery, licensed installation contractors, payment processing, and permit assistance. While we work with trusted partners, we recommend reviewing the terms, policies, and credentials of any third-party services you choose to use in connection with your project.

8. Service Management

East Texas Carports reserves the right to manage our services to ensure quality, safety, and legal compliance. We may monitor use of our website for terms violations, take legal action against violators, and cooperate with law enforcement. We reserve the right to remove content that violates our terms, refuse service to customers who engage in prohibited activities, and limit or modify service availability. To maintain quality, we may screen project requests for feasibility, require additional documentation for large projects, and prioritize projects based on scheduling and resources.

9. Privacy Policy

Your privacy is important to East Texas Carports. Our full data collection and use practices are detailed in our Privacy Policy. In summary: we collect information necessary to provide steel building services, your data is used for quotes, project management, and customer service, we implement security measures to protect your personal information, and we do not sell your personal information to third parties.

Our services are hosted in the United States. If you access our services from outside the US, you consent to having your data transferred to and processed in the United States. You have the right to access, update, or request deletion of your personal information — contact us at info@easttexascarports.com or (903) 234-8922 to exercise your privacy rights.

10. Term & Termination

These Legal Terms remain in effect while you use East Texas Carports services, until terminated by either party. We reserve the right to deny access or terminate services immediately and without notice for violation of these terms or applicable laws, fraudulent or deceptive activity, non-payment, or if we determine service is not feasible or safe.

Upon termination, your right to use our services immediately ceases, we may delete or restrict access to your account information, outstanding project obligations must be resolved, and you remain liable for any unpaid services or damages. Provisions covering intellectual property, payment and warranty obligations, limitation of liability, indemnification, and governing law survive termination. If we terminate your access for violations, you are prohibited from creating new accounts under your name, a fake name, or a third party's name.

11. Modifications & Interruptions

We reserve the right to change, modify, or remove website content at any time, update our custom builder tool and pricing algorithms, modify service offerings, and update pricing, policies, and terms of service. Our services may be temporarily unavailable due to scheduled maintenance, hardware or software problems, network issues, or force majeure events. We have no obligation to regularly update website information, maintain compatibility with older browsers, or continue offering any particular feature, and we have no liability for loss, damage, or inconvenience caused by service interruptions or modifications.

12. Governing Law

These Legal Terms and your use of East Texas Carports services are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Our services are subject to Texas state building codes and construction regulations, local building permit requirements in each service area, federal commerce and consumer protection laws, and industry standards for steel construction and safety. While we operate across multiple states (Texas, Arkansas, Oklahoma, Louisiana, Kansas, Mississippi), all legal disputes are governed by Texas law and resolved in Texas courts as specified in our dispute resolution section below.

13. Dispute Resolution

Any legal action brought by either party must be commenced in state or federal courts located in Gregg County, Texas, and is subject to Texas state law and procedures, resolved without regard to conflict of law principles. By using our services, you consent to jurisdiction in Gregg County, Texas courts, waive all defenses of lack of personal jurisdiction, waive any forum non conveniens objections, and agree that Texas courts are the exclusive venue for disputes.

The United Nations Convention on Contracts for International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are specifically excluded from applying to these terms.

14. Corrections

Our website and services may contain typographical errors, inaccuracies, or omissions regarding product descriptions, pricing, availability, and service area coverage. East Texas Carports reserves the right to correct any errors or omissions at any time, change or update information without prior notice, and revise pricing, specifications, and policies. For significant corrections affecting active projects or quotes, we will notify affected customers promptly, provide revised quotes as necessary, confirm project specifications before proceeding, and communicate price changes before final orders.

15. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAST TEXAS CARPORTS' LIABILITY IS LIMITED AS DESCRIBED BELOW. THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.

East Texas Carports disclaims all warranties, including warranties of merchantability and fitness for a particular purpose, non-infringement and accuracy, uninterrupted or error-free service, and completeness or currentness of information. We make no warranties about the accuracy of our custom builder tool's estimates, the completeness of website content, the availability of website features, or the security of data transmission. We do not warrant or assume responsibility for products or services offered by third parties, websites linked from our services, third-party contractors, or local building codes and permit requirements.

Your use of our services is at your sole risk. We will not be liable for errors or inaccuracies in content, personal injury or property damage from service use, unauthorized access to servers or personal information, interruption of service, or bugs, viruses, or harmful code from third parties.

16. Limitation of Liability

Under no circumstances will East Texas Carports, our directors, employees, or agents be liable for indirect, consequential, incidental, or punitive damages; lost profits, revenue, data, or business opportunities; damages arising from third-party actions; or losses from website downtime or service unavailability.

Maximum Liability Cap

Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim, or $1,000, whichever is less.

17. Indemnification

You agree to defend, indemnify, and hold harmless East Texas Carports, including our subsidiaries, affiliates, officers, agents, partners, and employees, from any loss, damage, liability, claim, or demand arising from your use of our services, your violation of these Legal Terms, your breach of representations and warranties, or your violation of third-party rights — as well as project-related claims such as site preparation or access issues, failure to obtain required permits, violations of local building codes, or property damage not caused by our negligence.

We reserve the right, at your expense, to assume exclusive defense and control of any indemnified matter, settle claims as we deem appropriate, and require your cooperation and select counsel for our defense. We will use reasonable efforts to notify you of any claim subject to indemnification, but failure to notify does not relieve your obligations except to the extent you are materially prejudiced.

18. User Data

East Texas Carports will maintain certain data you transmit to our services, including customer contact information and project details, quote history and preferences, communication records, and website usage data. While we perform regular routine backups, you are solely responsible for all data you transmit, and we recommend maintaining your own records of quotes, contracts, and communications — backup schedules are not guaranteed.

You acknowledge that we have no liability for any loss or corruption of data, you waive any right of action for data loss, and data recovery services are not guaranteed.

19. Electronic Communications

By using East Texas Carports services, you consent to receive electronic communications, including email confirmations and project updates, electronic contracts and agreements, digital invoices, and service and policy notices. You agree to the use of electronic signatures, contracts, and records for service agreements, change orders, payment authorizations, and legal notices — these satisfy legal requirements for written communication and have the same legal effect as physical documents. You waive any rights or requirements under statutes or regulations requiring original signatures, non-electronic records, paper delivery, or non-electronic payment methods.

20. California Users & Residents

If you are a California resident and have a complaint with East Texas Carports that is not satisfactorily resolved, you may contact the California Department of Consumer Affairs, Complaint Assistance Unit, Division of Consumer Services, 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.

21. Miscellaneous

  • Entire Agreement: These Legal Terms, together with our Privacy Policy and any project-specific contracts, constitute the entire agreement between you and East Texas Carports.
  • Waiver: Our failure to exercise or enforce any right or provision does not constitute a waiver of that right or provision.
  • Severability: If any provision is determined unlawful, void, or unenforceable, that provision is severable and does not affect the remaining provisions.
  • Assignment: We may assign our rights and obligations under these terms to others at any time. You may not assign your rights without our written consent.
  • Force Majeure: We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, or technical failures.
  • No Joint Venture: These terms do not create any joint venture, partnership, employment, or agency relationship between you and East Texas Carports.
